the max_file_uploads setting in php includes file input boxes from a form that have no file attached surely this is a fundamental flaw and this setting should also be in a per directory basis especially as this setting breaks many sites that ran fine before

Duplicate; this has also been fixed for PHP 5.3 and trunk; it will not count anymore from PHP 5.3.4 onward.
