i didn't know which "type of bug" i should choose for this error in PHP5

my situation
w2k+php5cvs05.01.04-19:30 (cli)

error_reporting E_ALL

how do you see php doesn't notice that i have an syntax error...

Reproduce code:
while( substr($data,3,1 != ' ') )
   if( !$data = $this->recv_data($buf_size) ) return FALSE;


Expected result:
PHP should say that i have an syntax error :)

Actual result:
no report
