It is not important if the php script contains anything

Changing /etc/httpd/php3.ini entry filesize and restarting 
apache does not change anything here!!.

I use apache v. 1.3.6.10

Try the current version of PHP (3.0.13) and while you are at it upgrade to Apache-1.3.9.  If the problem persists, re-submit.
