After i upgraded from PHP 4.2.2 to PHP4.3.0 i found OpenBaseDir no longer worked.
if i have 2 vhosts in apache and one vhost is using openbasedir and one vhost isnt using the restrion both vhosts will be subject to the restriction anyway.
this is also with openbasedir disabled in /usr/local/lib/php.ini

long story short, very dissapointed and i have downgraded back to php4.2.2
