Configured php with no options simpley ./configure

I can reproduce this problem with 2 webservers 
Apache 1.3.22 and mini_httpd (Latest Version) 

When ever I run any script as a cgi the shebang line is printed out. 

Running it from the command line does not produce the error. The script runs fine except for the above

This should be fixed in CVS already. Try a snapshot from http://snaps.php.net/
